1. Agreement to these Terms
These Terms of Service ("Terms") govern your access to and use of TheVideoGen, including our websites, applications, APIs, catalog, agent chat, generation pipelines, and related services (collectively, the "Service"). By creating an account, signing in, clicking "Continue with Google," or otherwise using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service. If you use TheVideoGen on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" includes that entity.
2. The Service
TheVideoGen is a creative platform that helps you direct AI-generated video and images using prompts, uploads, project briefs, and catalog references. Features may include catalog search, remix flows, agent chat, prompt packs / shot plans, and queued GPU generation through third-party or self-hosted models.
We may change, suspend, or discontinue any part of the Service at any time. Beta or experimental features are provided as-is and may be modified or removed without notice.
3. Accounts and eligibility
- You must be at least 18 years old (or the age of majority where you live).
- You must provide accurate account information and keep your credentials and linked sign-in provider secure.
- You are responsible for all activity under your account, including generations started by anyone you authorize.
- We may refuse, suspend, or terminate accounts that violate these Terms, create risk, or abuse infrastructure (including rate limits and GPU queues).
4. Catalog references and rights
TheVideoGen uses catalog frames as visual references to help you direct AI-generated video. You do not receive ownership of the underlying films, commercials, or music videos. Outputs you generate are your user-generated content, subject to our Terms. Do not use TheVideoGen to redistribute copyrighted source media.
- Catalog stills, clips, and metadata are provided for reference-led generation and creative direction—not as a library of redistributable source films, commercials, or music videos.
- TheVideoGen does not transfer ownership of underlying third-party media, trademarks, personalities, or production IP shown in the catalog.
- You must not scrape, bulk-download, rehost, or redistribute catalog source media, or attempt to obtain full titles through the Service.
- Some assets may be restricted. We may block access to media that violates our rights policy or applicable law.
5. Your content
"User Content" means prompts, brief text, uploads (images, video, audio, documents), character / look / set references, project data, chat messages, and outputs you generate through the Service.
Ownership. As between you and TheVideoGen, you retain rights in your User Content to the extent you already own them, subject to these Terms and third-party model provider terms. TheVideoGen does not claim ownership of your prompts or the new outputs the Service generates for you.
License to operate the Service. You grant TheVideoGen a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and create technical copies of User Content solely as needed to provide, secure, debug, and improve the Service (including running model inference, storing project history, and preventing abuse).
Your warranties.You represent that you have all rights needed to submit User Content and to grant the licenses above, and that your User Content and use of outputs will not infringe others' rights or violate law.
6. AI outputs and disclaimers
- Outputs are generated by probabilistic models and may be inaccurate, biased, incomplete, or unexpected. You are solely responsible for reviewing outputs before any commercial, public, or consequential use.
- TheVideoGen does not guarantee that outputs are unique, non-infringing, or free of third-party likenesses, brands, or styles.
- You must not present AI outputs as unassisted human work where disclosure is required by law or platform policy.
- Third-party model providers (and their terms) may apply to specific generation paths. Those terms can limit commercial use, retention, or permitted content.
7. Acceptable use
You agree not to use the Service to:
- Violate applicable law, court orders, or the rights of others.
- Infringe copyright, trademark, publicity, privacy, or other IP rights—including by redistributing catalog source media.
- Create or disseminate child sexual abuse material, or any sexual content involving minors (including fictional depictions).
- Create non-consensual intimate imagery, deepfakes intended to deceive, or content that harasses, threatens, or exploits people.
- Generate content that facilitates violent crime, terrorism, weapons development, or severe physical harm.
- Attempt unauthorized access, probe, scrape beyond permitted product use, overload, or disrupt TheVideoGen infrastructure, APIs, or GPU workers.
- Circumvent rate limits, usage metering, billing, rights flags, or safety controls.
- Resell or white-label the Service without a written agreement with TheVideoGen.
We may remove content, throttle usage, or suspend accounts when we reasonably believe these rules are violated.
8. Intellectual property of TheVideoGen
The Service—including software, UI, branding, documentation, and non-catalog datasets—is owned by TheVideoGen and its licensors. These Terms do not grant you any right to copy, modify, reverse engineer (except to the extent mandatory law allows), or create derivative works of the Service itself, other than as needed for normal use.
9. Copyright complaints
If you believe material on the Service infringes your copyright, send a notice to legal@thevideogen.com with: (a) your contact details; (b) identification of the work claimed infringed; (c) the URL or location of the allegedly infringing material; (d) a statement of good-faith belief that use is not authorized; and (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act. We may remove or disable access to material and, where appropriate, terminate repeat infringers.
10. Fees, credits, and taxes
Some features may require a paid plan, credits, or usage-based charges. Prices, quotas, and billing intervals will be shown in-product or in an order form. Fees are generally non-refundable except where required by law or expressly stated. You are responsible for applicable taxes. Failure to pay may result in suspension.
11. Third-party services
The Service may integrate Google sign-in, cloud storage, model APIs, analytics, and payment processors. Your use of those services may be subject to their own terms and privacy policies. TheVideoGen is not responsible for third-party services we do not control.
12. Confidentiality and security
You must not attempt to extract secrets, weights (except where we expressly provide downloadable assets), private keys, or other users' data. We implement reasonable administrative and technical safeguards, but no system is perfectly secure. Promptly notify us of suspected unauthorized access at security@thevideogen.com.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAME DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI FEATURES ARE EXPERIMENTAL BY NATURE.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRAME AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FRAME FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.
15. Indemnity
You will defend and indemnify TheVideoGen and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of outputs, your breach of these Terms, or your violation of law or third-party rights.
16. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access immediately for violations, legal risk, non-payment, or prolonged inactivity. Upon termination, your right to use the Service ends. Sections that by nature should survive (including ownership, licenses needed for residual copies, disclaimers, liability limits, and indemnity) will survive.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, provide additional notice where required. Continued use after the effective date constitutes acceptance.
18. Governing law
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict of law rules, unless mandatory consumer protections in your country of residence require otherwise. Courts in Wilmington, Delaware will have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court for IP or misuse of the Service.
